A judge in California is facing significant criticism following his attempt to obstruct President Trump’s directive to deploy the National Guard in Los Angeles, which resulted in an impeachment resolution from a Republican legislator. This lawmaker contended that the judge’s ruling was politically motivated and asserted that the purpose of the resolution was to ensure judges fulfill their responsibilities.
To provide context, on June 27, 2025, Representative Randy Fine (R-FL) put forth a resolution in the House of Representatives seeking to impeach Judge Charles Breyer of the Northern District of California for what he termed as “high crimes and misdemeanors.” This resolution was prompted by Judge Breyer’s ruling that interfered with President Trump’s deployment of the National Guard to address the violent protests against Immigration and Customs Enforcement (ICE) in Los Angeles, which erupted on June 6.
As reported by the media, Judge Breyer argued that the President had not adhered to the “congressionally mandated procedure for his actions” when he authorized the Department of Defense to send National Guard units to Los Angeles. Judge Breyer allegedly stated, “His actions were illegal—both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution.”
Furthermore, Judge Breyer indicated that the Court needed to step in “at this early stage of the proceedings,” asserting that the President “must therefore return control of the California National Guard to the Governor of the State of California forthwith.” Additionally, Breyer claimed that the protests in Los Angeles “fall far short of ‘rebellion.'” However, reports confirmed that Judge Breyer’s ruling was swiftly overturned.
In reaction to Judge Breyer’s remarks, Representative Randy Fine introduced his resolution in the House, stating that the judge “knowingly and willfully” utilized his judicial authority “to advance political gain while interfering with the President’s constitutional prerogatives and enforcement of the rule of law.”
Moreover, the congressman stated that the United States Constitution grants Congress the power to exercise “the sole Power of Impeachment” to charge “civil Officers of the United States,” asserting that all civil officers, “including Federal judges, are liable to impeachment and removal.”
Furthermore, Representative Fine stated that the judge, through his conduct, had “breached his oath to the Constitution and his obligation of impartiality to the citizens of the United States,” further asserting that Breyer “misused the powers of his judicial position, having participated in actions that favor political advantage over the impartiality owed to the public and litigants.” The congressman subsequently contended that, in light of his actions, the judge “is culpable of high crimes and misdemeanors and ought to be dismissed from his position.”
In a press statement, Rep. Fine expressed his belief that the judge’s ruling was influenced by political motives, stating, “The objective is to ensure judges fulfill their responsibilities. If we do not attempt to hold those who fail to do so accountable, they will lack the motivation to change their behavior.” Additionally, the congressman remarked that although his resolution may not lead to Judge Breyer’s removal from his position, it is still “worth pursuing.”
